Your Questions, Answered
General IP Questions
What is intellectual property (IP)?
Intellectual Property (IP) refers to creations of the mind, such as inventions, literary and artistic works, designs, symbols, names, and images. These are protected by law to give creators rights over how their work is used.
Who owns the IP created at DLSU?
DLSU generally owns the intellectual property created by its faculty, staff, and students when the creation is part of their regular duties, made using significant university resources, or funded by the university or external parties through DLSU. However, creators may retain ownership of certain works, such as those developed independently without substantial use of university resources or outside their assigned tasks, as detailed in the IP policy.
What does the DLSU IP Office (DIPO) do?
The DLSU Intellectual Property Office (DIPO) manages the university’s intellectual property by assisting in the identification, protection, and management of IP assets. It oversees disclosures, patent filings, and copyright registrations, ensures compliance with IP policies, and supports commercialization and knowledge transfer efforts in coordination with researchers, faculty, students, and external partners.
IP Learning and Awareness (PLANT)
How can I attend an IP awareness session?
You may follow our facebook page (https://www.facebook.com/DLSUDIPO) or watch out for HDAs released by DIPO on IP Awareness activities.
What programs does DIPO offer for IP education?
DIPO conducts intellectual property education and awareness programs such as orientations, training sessions, and workshops for faculty, students, and staff. DIPO also collaborates with other units to integrate IP education into academic and research-related activities.
What is the Strategic Management of IP Certificate Course?
Strategic Management of Intellectual Property (SMIP) Certificate Course is composed of 6 weeks worth of self-paced learning of modules and 8 online sessions about strategic insights on managing IP assets effectively.
IP Protection Services (PROTECT)
How do I disclose an invention?
To disclose an invention at DLSU, you must submit a completed Invention Disclosure Form to the DLSU Intellectual Property Office (DIPO). The form should include all relevant technical information and the names of inventors or contributors. This disclosure is the first step toward evaluating the invention’s patentability, determining ownership, and deciding whether to proceed with IP protection and commercialization.
What’s the process for filing a patent or copyright?
At DLSU, filing a patent or copyright begins with submitting an Invention or Work Disclosure Form to the Intellectual Property Office (DIPO). The office evaluates the submission for protection potential and alignment with university policies. For patents, a prior art search and patentability assessment are conducted. If the invention is approved for filing, DIPO coordinates the preparation and submission of the patent application with the inventor. For copyrightable works, DIPO helps with registration through the Bureau of Copyright and Related Rights (BCRR) of IPOPHL. Throughout the process, DIPO provides guidance and support to the creators.
What IP types can I protect through DLSU?
Through DLSU, you can protect various types of intellectual property, including patents, utility models, industrial designs, copyright, trademarks, plant varieties, and undisclosed information or trade secrets.
Commercialization and Utilization (PURSUE)
How can my innovation be commercialized?
At DLSU, innovations can be commercialized through several pathways coordinated by the Innovation and Technology Office (DITO). These include licensing agreements, spin-offs or startups, and collaborations with industry partners. The process typically begins after disclosing your invention or work, followed by evaluation for commercial potential. DITO, in coordination with DIPO, supports this by developing marketing strategies, identifying potential partners, managing IP rights, and assisting with funding applications related to commercialization efforts.
What is DLSU’s approach to licensing and revenue sharing?
DLSU may license or assign its intellectual property to external parties as part of its technology transfer strategy. When income is generated from commercialization, such as through licensing, royalties, or equity, the net revenue is shared between the university and the creators. According to policy, 60% of the net revenue goes to the university, and 40% is distributed among the inventors or creators, unless a different arrangement has been made. This applies to income from royalties or liquidation of equity interests related to DLSU-owned intellectual property.
DLSU Marks and Trademark Use
Can I use the DLSU logo on merchandise?
You cannot use the DLSU logo on merchandise without prior written permission. The university retains ownership of its trademarks, including names, logos, and insignia. Any use, especially for commercial purposes, requires official approval. Unauthorized use may violate DLSU’s intellectual property policies and branding guidelines.
Do student orgs need approval to use DLSU marks?
Yes, student organizations must obtain prior written approval to use DLSU’s official marks, including its name, logo, and insignia. These are considered university-owned intellectual property, and any use, whether for events, publications, or merchandise, must comply with DLSU’s IP policies. Unauthorized use may result in policy violations or disciplinary action.
Are there fees for trademark use?
Yes, the use of DLSU-owned trademarks, including the university name, logo, or insignia, may be subject to fees if used for commercial purposes such as on merchandise. These fees are determined through licensing or other formal agreements and are intended to ensure appropriate use and benefit to the university.
