  • Refers to the political and other related processes involved in amending or revising the current 1987 Constitution of the Philippines
  • Under the current constitution there are three modes of which it could be amended:
    • People's Initiative (PI)
    • Constituent Assembly
    • Constitutional Convention
  • Historically, Supreme Court of the Philippines retired Associate Justice Isagani A. Cruz, a political, constitutional and international law authority stated that "Cha-cha was shut down by the Supreme Court in Santiago v. Commission on Elections, 270 SCRA 106, and Pirma v. Commission on Elections, G.R. No 129754, 9/23/97, and was again slaughtered in Lambino v. Commission on Elections, 505 SCRA 160, in 360 pages of judicial verbosity."
  • The first Charter Change attempt on the 1987 Constitution was under former President Fidel V. Ramos. Among the proposed changes in the constitution included a shift to a parliamentary system and the lifting of term limits of public officials.
Bayani Fernando
  • Metropolitan Manila Development Authority (MMDA) Bayani Fernando said he is for amending the Philippine Constitution, but only after the 2010 election[2].
Chiz Escudero
  • "There is no possibility—in my opinion—that charter change will push through," Escudero assured. "There is no possibility in the Congress; there is no possibility in the Senate; there is no possibility in the Supreme Court; and there is no possibility that the Filipino people would welcome and accept it," he added[3].
  • As Chairman of the Philippine Senate’s Constitutional Amendments Committee, Escudero promised that he would not allow a charter change to happen under President Arroyo’s watch[3]. 
  • Senator Chiz Escudero vowed to block any move to pursue charter change in the Senate for as long as he is the Chair of the Senate Committee on Constitutional Amendments[4]
  • Escudero said he is not totally averse to charter change. "If and when we need to amend the Constitution, we should do it at the start of a new administration to dispel any doubts about personal motives and agendas," he stressed[4].
Dick Gordon
  • He insisted on the lawful process of charter change only according to the process set forth in the Constitution[5] .
  • He opposed the unconstitutional ways of proposing charter change, including the orchestrated people’s initiative in 2006 and was one of the triumphant parties in the case of Lambino and Aumentado vs. COMELEC, G.R. No. 174153, October 25, 2006[6].
Gilbert Teodoro
  • On his position on the controversial Charter change move, Diaz said Teodoro came in only when de Venecia opened the possibility of amending the Constitution by calling a referendum to get the people’s pulse, or through the election of delegates to a Constitutional Convention simultaneous with the May 14 elections[7].
Jejomar Binay
  • Mayor Jejomar Binay of Makati City, also chairman of the United Opposition, said he opposed Charter change, because the amendments would not likely be limited to the economic provisions. [8]
  • “All this talk about 2010 should not distract the opposition from its role as watchdog of the administration, especially attempts to revive constitutional reforms or "Charter change,"” said by Makati Mayor Jejomar Binay, a prospective presidential candidate. [9]
  • Makati mayor Jejomar Binay declared Makati City a Charter change-free city during a anti-cha-cha protest. [10]
Jinggoy Estrada
  • Senators Luisa Loi Ejercito Estrada and Jinggoy Ejercito Estrada advised Mrs. Gloria Macapagal Arroyo and her subalterns to change their character instead of persisting on efforts to change the Constitution[11].
Joker Arroyo
  • “Well, frankly, I don't want to think about it, eh. So because if I do, then, that's farthest in my mind that the moment. I want to think of the election. But Charter change, I knew, I'm opposed to it, I fought it, so I mean, I don't want to think about it eh because [laughs] I don't want my mind to be cluttered with Charter change at this point.”[12]
  • “I'm against it. I'm in opposed to it. I don't think that's the solution.”[12]
  • Sen. Joker Arroyo would put it, “There will be blood. They can pursue it over our dead body. I will oppose it. I am against it. It is not proper at this time. It is dead in the water”.[13]
Joseph Estrada
  • Former President Joseph Estrada attempted to change the 1987 constitution during his term as President[14]
  • He has assured anti-Charter Change advocates that he would join the anti-cha-cha rally in Makati City before, noting that he must be there to represent the masses and to ensure the people would not be "deprived of having a duly elected President[15].
  • Estrada said that he cannot and will not allow Pres. Gloria Macapagal Arroyo nor the power-hungry congressmen to stay in power beyond 2010 through Charter Change[15].
Kiko Pangilinan
  • Pangilinan and his fellow members of the Senate minority issued the statement on stopping Charter change, or “Cha-cha,” after 163 congressmen signed a joined resolution seeking to convene the House and the Senate into a Constituent Assembly to tinker with the Constitution[16].
  • Senator Francis Pangilinan said it is clear the initiative (Cha-cha) being pushed by the administration is not in the interest of the country but of the few people in power[17].

Loren Legarda

  • Made a strong pitch, as she prodded the Arroyo administration and its Congress allies to ditch their Charter-change schemes and instead focus on strengthening the economy through a “fiscal-stimulus package” in the face of a global financial crisis that has evolved into an economic slump[18].
  • She stated in Bagiuo city that “’Cha-cha’ (charter change) will not happen” during a press conference held at Prince Plaza Hotel last Feb. 21, 2009[19].
  • Sen. Loren Legarda made a statement as she challenged the members of the Supreme Court to rule wisely on the issue of charter change, "I don’t think that the members of the High Court will stake their legacy, their name even if they were appointed by the President, that they will rule in favor of just one house, one house deciding to change the form of government," she stressed[20].
Manny Villar
  • Senator Manny Villar has warned that the plan to amend the economic provisions of the Constitution could be simply a “decoy” that would eventually lead to the complete overhaul of the country's fundamental law[21].
  • Files Senate Resolution 599, a resolution which said that the House resolution seeking the amendment of the constitution is "unconstitutional[22].
Mar Roxas
  • Malacañang officials are sore at Sen. Manuel "Mar" Roxas II over his expletive-laced speech against the Arroyo administration at an anti-Charter change rally[23].
  • Mar Roxas stated that Cha-cha is the worst possible gift the people could receive and he also stated, “Instead of feeding the people or helping them in other ways, politicians are only focusing on their interests” he said[24].
Miriam Santiago
  • Santiago said Charter change, or “Cha-cha,” could push through in 2009 if the position of the House of Representatives on the computation of the three-fourths vote needed to convert Congress into a constituent assembly would hold sway[25].
  • Senator Miriam Defensor Santiago stated that a push for any constitutional amendment might pave the way for massive protests like those in Thailand[26].
  • Sen. Miriam Defensor Santiago believed that she did the politically correct thing in supporting the move to shift to a unicameral parliamentary government[27].
Noli de Castro
  • Mr. de Castro said charter change in itself is not bad but it would depend on the provisions to be amended[28].
  • He said while the lifting of term limits would benefit officials like him, he would not support it if this is opposed by the public[28].
Pia Cayetano
  • Senator Pia Cayetano joined calls for Arroyo to stop moves to amend the Constitution[29].
  • Sen. Pia Cayetano echoed Pangilinan’s opposition to “Cha-cha.” “We may just be the minority in the Senate, but we share the sentiments of the overwhelming majority of our people who are opposed to any changes in the Charter before 2010,” she said[30].
Ping Lacson
  • Lacson said that senators had also made their position on Charter change clear, and that was why “there was no way that Cha-cha, will succeed in the Senate.”[31]
  • Sen. Panfilo Lacson said both Houses of Congress and the people would not allow Charter change to happen[32]
